The good news is, the process of dealing with a car accident in a leased vehicle looks very similar to what you would do if you owned the car or had a traditional car note. But there are a few additional considerations you should be aware of to avoid a potential financial penalty at the end of your lease.
The first thing you should do immediately after any car accident, no matter who was at fault, or the ownership status of the car, is to call the police and have a report filed. Then, get checked out by a doctor – whether you think you are injured or not.
After that, do the following:
Report the Accident to Your Insurance Company
Ideally, you have car insurance and are up to date on your premiums. Nearly all car lease contracts have a provision that requires the lessee to maintain a certain level of insurance.
You want to call your insurance company as soon as possible after the crash so they can send a claims adjuster out to assess the damage. Give them the basic information they need, such as the location of the accident, the names of all parties involved, the make and model of your vehicle, and so forth. But refrain from speaking on topics such as fault or who was to blame. If the insurance company asks pointed questions about fault or the details of the accident, politely decline and tell the adjuster that you will first consult your lawyer.
Notify the Leasing Company
Never get any repairs done on your vehicle before you talk to the leasing company or the dealership where you took out the lease. Here are a few reasons why:
- Many car leases do not allow aftermarket parts to be put in a vehicle, even in a repair situation.
- Another possibility is that the lease requires that repairs be completed at a service location that is certified by the manufacturer (for instance, at a Ford dealership if the car is a Ford).
Failing to comply with such rules could result in a major financial penalty when you turn in your vehicle and the dealership notices the unauthorized repairs. Thus, always notify the dealership of an accident, and let them instruct you on what to do.
Hire an Attorney
It is a good idea to speak with an attorney before you have any detailed conversations about the accident with your insurance company or the other driver’s insurance company.
If you believe the other driver was partially or fully at fault, an attorney can help you pursue the maximum compensation. If the insurance company does not agree to pay the full amount you deserve, your attorney can file a lawsuit and try your case in front of a jury.
The legal team at the Law Firm of Anidjar & Levine does not collect payment until they recover money for you. This means there is no risk involved in having an attorney represent you.
